Sponsor: Tier 1 Outfitters LLC d/b/a Tier 1 Kinetics (“Sponsor”), 1220 North 80 East, Unit 14, Lake Point, UT 84074; website: tier1kinetics.com. This is a manufacturer (FFL Type 07) of firearms.

These Official Rules govern the Tier 1 Kinetics MAX-8 Complete Setup Giveaway (the “Giveaway” or “Sweepstakes”). By entering, each entrant agrees to be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all respects.

1. Eligibility

The Giveaway is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age (or the age of majority in their jurisdiction of residence, whichever is older) at the time of entry and who are legally eligible under all applicable federal, state, and local laws to purchase, receive, possess, and own a firearm.

Prohibited Persons (Federal Baseline – 18 U.S.C. § 922(g) and related provisions):
It is unlawful for any of the following persons to ship, transport, receive, or possess firearms or ammunition. Entrants and potential winners must not fall into any of these categories (or equivalent/additional state or local prohibitions):

• Convicted in any court of a crime punishable by imprisonment for a term exceeding one year.
• Fugitive from justice.
• Unlawful user of or addicted to any controlled substance (as defined in 21 U.S.C. § 802).
• Adjudicated as a mental defective or committed to any mental institution.
• Illegal alien or (with limited exceptions) admitted under a nonimmigrant visa.
• Discharged from the Armed Forces under dishonorable conditions.
• Having renounced U.S. citizenship.
• Subject to a court order restraining the person from harassing, stalking, or threatening an intimate partner or child of such intimate partner (meeting the statutory criteria).
• Convicted of a misdemeanor crime of domestic violence.

Additionally, under 18 U.S.C. § 922(n), persons under indictment for a crime punishable by imprisonment exceeding one year are prohibited from receiving firearms.

States and localities impose additional restrictions (including, without limitation, certain violent misdemeanors, extreme risk protection/red-flag orders, specific mental-health adjudications, juvenile adjudications, or other categories). The winner must also comply with all state and local laws applicable to the specific firearm configuration (barrel length, stock/brace, magazine capacity, “assault weapon” features, etc.). The prize configuration may be illegal or heavily restricted in certain jurisdictions (examples include but are not limited to California, New York, New Jersey, Massachusetts, Connecticut, Hawaii, Maryland, and others with assault-weapon or feature-based bans).

Employees, officers, directors, and agents of Sponsor, its affiliates, advertising/promotion agencies, and members of their immediate families (spouse, parents, siblings, children) and/or household members are not eligible. The Giveaway is void where prohibited or restricted by law.

By entering, you represent and warrant that you are not a prohibited person under federal, state, or local law and that you can lawfully take possession of the prize firearm in your state of residence.

2. Promotion Period

The Giveaway begins on or about the date the Instagram/Woobox promotion is publicly posted by Sponsor and ends on the date announced by Sponsor on the official Instagram post or Woobox page (the “Promotion Period”). Sponsor’s computer/server is the official timekeeping device. Entries received outside the Promotion Period are void.

3. How to Enter

No purchase necessary. Enter via the official Woobox page linked from Sponsor’s Instagram (@tier1kinetics) or related promotional posts during the Promotion Period. Standard entry actions (as configured on the Woobox page) typically include:

• Follow @tier1kinetics on Instagram.
• Like the official giveaway post.
• Tag friends in the comments.
• Share the post to Stories.
• Visit the Tier 1 Kinetics website.
• Refer friends via unique referral link (bonus entries).

Entry limits and exact point values are as displayed on the Woobox entry page. Multiple entries are permitted only as allowed by the platform mechanics; any attempt to exceed limits or use automated/scripted means may result in disqualification.

Alternate Method of Entry (AMOE) / Free Entry: If any entry method involves or is conditioned on a purchase, a free mail-in or other no-purchase method of equal odds will be (or is) provided and must be clearly disclosed. All free entries have the same chance of winning as any other entries.

Limit: As stated on the entry page (typically one account/person). Incomplete, illegible, or fraudulent entries are void. Sponsor is not responsible for lost, late, incomplete, or misdirected entries or technical failures.

4. Winner Selection and Notification

One (1) potential winner will be selected in a random drawing from among all eligible entries received during the Promotion Period. Odds of winning depend on the number of eligible entries.

Potential winner will be notified via the contact information associated with the entry (email, Instagram DM, or as configured on Woobox) within a reasonable time after the drawing. Potential winner must respond and complete required documentation (including Affidavit of Eligibility, Liability/Publicity Release, and FFL dealer information) within the time specified (typically 48–72 hours or as stated). Failure to respond timely, or failure to meet eligibility/transfer requirements, results in forfeiture and selection of an alternate winner.

5. Prize

One (1) Grand Prize: Tier 1 Kinetics MAX-8 Complete Setup package consisting of a Tier 1 Kinetics MAX-8 firearm (configuration as offered/promoted, typically featuring Maxim Defense SCW stock or pistol brace options, approximately 10.3” barrel platform), Aimpoint T-2 optic, Somogear NGAL (or equivalent laser aiming module as promoted), and GBRS Hydra Mount (or equivalent).

Approximate Retail Value (ARV): Approximately $4,500–$5,500 (based on current MSRP/street pricing of the MAX-8 at ~$3,399 plus accessories; actual ARV may vary and will be determined by Sponsor at time of award). Prize is awarded “as is” with no warranties beyond any manufacturer warranties that transfer.

Firearm Transfer Requirements (Critical Compliance):

• The prize firearm will be transferred only through a federally licensed firearms dealer (FFL) in the winner’s state of residence (or as otherwise required by law).
• Winner must complete ATF Form 4473 and successfully pass a National Instant Criminal Background Check System (NICS) check (and any state-required checks).
• Winner is solely responsible for selecting and coordinating with a receiving FFL, any transfer fees charged by the FFL, shipping costs if applicable (Sponsor typically covers shipping to the FFL), sales/use taxes, and all other costs of taking possession.
• Winner must provide valid FFL information and complete all required paperwork within the timeframe set by Sponsor.
• If the potential winner is unwilling, unable, or legally barred from receiving the transfer (including failure of background check, state/local prohibition on the configuration, or any other reason), the prize is forfeited with no cash substitute or alternative prize of equal value unless Sponsor elects otherwise in its sole discretion. An alternate winner may be selected.
• Sponsor will not ship a firearm directly to any non-FFL individual across state lines. All transfers comply with the Gun Control Act, National Firearms Act (if applicable to the final configuration), and ATF regulations.

Winner is responsible for all federal, state, and local taxes on the prize. Sponsor will issue an IRS Form 1099-MISC if required (generally for prizes valued at $600 or more).

No substitution, transfer, or cash redemption of the prize except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.

6. Additional Conditions

• Winner may be required to execute additional documents and consent to a background verification consistent with firearm transfer requirements.
• By accepting the prize, winner grants Sponsor the right to use winner’s name, likeness, city/state, and statements for promotional purposes without further compensation, except where prohibited.
• Sponsor reserves the right to disqualify any entrant who tampers with the entry process, violates these Rules, or acts in a disruptive or fraudulent manner.
• Sponsor is not responsible for any injury, loss, or damage arising from participation or acceptance/use of the prize, to the fullest extent permitted by law.
• These Rules are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Utah.

7. Winner List / Privacy

For the name of the winner (available after the Promotion Period and winner confirmation), send a self-addressed stamped envelope to the Sponsor address above with the request “MAX-8 Giveaway Winner List.” Personal information collected will be used only for administration of the Giveaway and in accordance with Sponsor’s privacy policy, subject to applicable law (including CCPA where relevant).

Sponsor’s decisions are final. These Official Rules may be updated or clarified as needed for legal compliance. Entrants are solely responsible for ensuring their own eligibility under all applicable firearms laws.
